Learned counsel for the State has filed a counter affidavit, which may be kept on record.
The petitioner had challenged the order, dated 13.08.2009, passed by the Superintendent of Police, Bhagalpur, in Departmental Proceeding No. 102 of 2008 by which the petitioner was dismissed from service with effect from 13.08.2009 and affirmed by the Deputy Inspector General of Police, Eastern Region, Bhagalpur.
By Interlocutory Application No. 2631 of 2012 the petitioner has enclosed Annexure 9 by which his Memorial
Patna High Court CWJC No.12470 of 2011(6) dt.09-08-2018 2/2 before the Director General of Police, Bihar, has been disposed of on 16.12.2011 and the punishment of dismissal from service has been withdrawn. The petitioner submits that now this writ application has become infructuous.
