The petitioners seek regular bail in connection with Excise Case No.366 of 2017 registered for offences punishable under Sections 30(A)(D)(G) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioners is about recovery of 245 ltrs. of mahua liquor from a vehicle and the petitioners and other co-accused persons have been arrested at the spot. Submission of the learned counsel for the petitioners is that the petitioners have been falsely implicated in this case and nothing has been recovered from them. The petitioners have no criminal antecedent and they have remained in custody for 1 1⁄2

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction the learned court below that once the charge is framed or remains in custody for three months, whichever is earlier, he shall release the petitioner in connection with Case No.366 of 2017 to his own satisfaction.
