Earlier the prayer for bail of the petitioner was rejected by this Court taking note of nature of allegation levelled against the petitioner and again this Court is not inclined to release the petitioner on bail. Hence his prayer for bail in connection with Bakhtiarpur P.S.Case no. 94 of 2016 pending in the Court of learned 1st Additional Sessions Judge, Saharsa, stands rejected. However, the trial court has reported that out of eight prosecution witnesses, five witnesses have already been examined and, therefore, in the aforesaid circumstances, the trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible preferably within a period

Patna High Court Cr.Misc. No.37419 of 2017 (3) dt.11-10-2017 2/2 of six months from the date of receipt/ production of a copy of this order.

It is made clear that if the trial court fails to conclude the trial of the petitioner within the above said period of six months due to laches of the prosecution, the petitioner may renew his prayer for bail before the learned trial court itself. (Hemant Kumar Srivastava, J) singh/- U T
