The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341, 323, 354, 504 and 506/34 of the Indian Penal Code. The prosecution case is that on 16.03.2015, the accused persons put a letter on the door of the informant containing vulgar contents and, thereafter, the accused persons used to tease the informant. Lastly, on 28.05.2015 at 7 pm., the accused persons tried to catch hold the informant but the informant escaped from the scene.
It is submitted by learned counsel for the petitioners that for the initial occurrence of 16.03.2015 and later on 28.05.2015, the FIR was registered on 14.06.2015 and at earlier
Patna High Court Cr.Misc. No.44960 of 2015 (3) dt.02-11-2015 2/2 point of time, father of the informant lodged a case against the petitioners, as they were inimical terms with the family members of the informant. It is further submitted that even assuming the accusation, no offence under sections 354, 504 and 506/34 of the Indian Penal Code is made out.
Considering the delayed lodging of the case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Fatehpur P.S. Case No.198 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
