JUSTICE SATYAVRAT VERMA ORAL ORDER 08-02-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Mairwa P. S. Case No.17 of 2021, instituted for the offences under Section 392 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 27.04.2021 and charge-sheet has been submitted in the case.

The learned counsel for the petitioner submits that the informant alleges that while he was returning after collecting money, he was intercepted by three unknown criminals, who at the point of gun looted his bag containing Rs.10,510/-, motorcycle along with tab etc.

The learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.51820 of 2021(2) dt.08-02-2022 2/2 F.I.R. was against unknown and the name of this petitioner transpired in the confessional statement of Raju Kumar and the looted articles recovered from a bush near village-Aaniee. It is further submitted that nothing has been recovered from the possession of the petitioner and the petitioner has not been put on T.I. Parade.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and his name transpired in the confessional statement of co-accused, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-7th, Siwan in connection with Mairwa P. S. Case No.17 of 2021, subject to condition that one of the bailers shall be the father of the petitioner namely, Sipahi Yadav.

The application stands allowed.
