JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-09-2015 The petitioner being husband of the complainant is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioner on instruction that petitioner admits his marriage with the complainant and birth of a girl child. The petitioner is still ready to keep the complainant and girl child with full dignity and honour. A statement to that effect has been made in para 6 of the petition which reads as follows:-
Patna High Court Cr.Misc. No.43882 of 2015 (2) dt.15-09-2015 2/2 "That the petitioner is the husband of the O.P. No. 2 and has got all love and affection for her as well as for her child and is ready to keep them with all respect, love and human dignity."
It is submitted by learned counsel for the complainant that complainant is not ready to accept the offer of resuming the conjugal life. It is further submitted that petitioner is not making payment of maintenance amount as directed by learned Principal Judge, Family Court, Buxar in Maintenance Case No. 67M of 2014. Though petitioner claims that he is making payment of the maintenance amount. In the circumstance, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Buxar in connection with Complaint Case No. 706(C) of 2014. The bail bonds of the petitioner will be accepted on filing proof with regard to up-to-date payment of the maintenance amount.
