Supplementary Affidavit has been filed on behalf of the petitioner today in Court. Let it be kept with record. Petitioner seeks bail in Muzaffarpur Sadar P.S. Case No.400 of 2018 instituted for the offence under Section(s) 394, 302/34 Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that petitioner has been arrested merely on suspicion.
It is alleged in the written report that three unknown persons came on motorcycle and fired on brother-in-law of the informant.
First Information Report is against unknown. During
Patna High Court CR. MISC. No.39311 of 2019(3) dt.21-08-2019 2/2 investigation, police has recorded confessional statement of Mayank Thakur, who was remanded in this case from Sadar P.S. Case No.417 of 2018, and he disclosed name of the petitioner. Thereafter, petitioner was remanded in this case on 05.11.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Sadar P.S. Case No.400 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
