The petitioner apprehends his arrest in Madhubani Town P.S. Case No. 367 of 2015 registered for the offences punishable under Sections 467, 468, 406, 420 and 34 of the Indian Penal Code.
The informant, police inspector, Vigilance Investigation Bureau, Patna alleged that the petitioner filed his mark sheet bearing Roll No. 10441 and Roll Code 5104 of Intermediate Science examination showing that he got 555 marks but on verification it was found that the petitioner had obtained only 268 marks in the Intermediate Science examination. Learned counsel for the petitioner submits that, in fact, the petitioner got 268 marks and he was shown failed, but the
Patna High Court Cr.Misc. No.30218 of 2016 (3) dt.17-10-2016 2/2 petitioner filed petition for re-evaluation of his copy, thereafter the petitioner got 555 marks in the Intermediate Science examination. During the course of investigation, it has come in paragraph - 37 of the case diary that mark sheet of the petitioner after reevaluation was found correct and he obtained 555 marks in the Intermediate Science examination.
Learned APP did not dispute this fact.
Considering the facts aforesaid the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in Madhubani Town P.S. Case No. 367 of 2015, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
