JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-01-2022 Heard Mr. Ashok Kumar Jha, learned Advocate for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Fathuwa P. S. Case No. 335 of 2020, dated 12.05.2020, instituted for the offences under Sections 448, 341, 308, 379 and 34 of the Indian Penal Code.

The accusation against the petitioner is of assaulting one Deepak Kumar on his head by means of a lathi.

On the submission of the learned Counsel for the petitioner that there is no injury corresponding to the

Patna High Court CR. MISC. No.40217 of 2020(4) dt.18-01-2022 2/2 accusation levelled against the petitioner, case diary was called for and the petitioner was granted provisional bail by order dated 14.12.2021.

The case diary has since been received.

From perusal of case-diary, it appears that Deepak Kumar/victim has received injuries but all of those have been reported to be simple in nature. Considering this aspect of the matter, the provisional bail granted to the petitioner stands confirmed.

The petitioner shall remain on the same bail bonds.
