2. The petitioner apprehends his arrest in a case registered for the offence under Sections 420, 468, 469, 471 of the Indian Penal Code.
3. As per the prosecution case, the allegation against petitioner is that he alongwith other co-accused persons, under a conspiracy, got the land executed fraudulently in the name of co-accused Ladwan Devi.
4. Learned counsel for the petitioner submits that the dispute is with regard to sale and purchase of land, which is purely of a civil nature and only with a view to settle the civil dispute, this criminal case has been lodged. None of the acts
Patna High Court CR. MISC. No.46793 of 2024(2) dt.24-07-2024 2/2 allegedly committed by the petitioner gives rise to any criminal liability. It is out-and-out a civil dispute, for which, informant has got some other remedy. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Madhepura / concerned court in connection with Udakishanganj P.S. Case No. 248 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
