The petitioner has renewed his prayer for bail in a case registered under sections 363 and 372 of the Indian Penal Code and sections 3 and 4 of The Immoral Traffic (Prevention) Act, 1956 At the outset it is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 16.4.2021 (Annexure 1) passed in Cr. Misc. no. 37520 of 2020. Inspite of the petitioner having remained in custody since 4.6.2020, there is no progress in the learned trial Court. Further, the case of the petitioner stands on a similar footing to that of co-accused Chhotu Kumar Sah who has been enlarged on bail vide order dated 13.12.2017 (Annexure 4) passed in Cr. Misc. no. 58215 of 2017.

As per the report received contained in letter dated 8.10.2021, 22.10.2021 was the date fixed for appearance of the accused before the Court. Having heard learned counsel for the parties and taking into consideration the facts of the case, the period in custody, the stage of the case in the learned trial Court and grant of bail to co-accused Chhotu Kumar Sah, the Court directs the petitioner to be enlarged on bail in connection with Sahayak P.S. Case no. 339 of 2016 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
