====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-06-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 414 of the Indian Penal Code.

Prosecution case is that informant learnt that on 7.9.2020 one stolen truck has been brought by this petitioner and parked near the house of Pranav Kumar Rai. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent. Stolen truck was not recovered from the house of the petitioner.

Considering the nature of allegation, prayer for bail of

Patna High Court CR. MISC. No.51302 of 2021(2) dt.27-06-2022 2/2 the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in Marhowrah Police Station Case No. 799 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
