JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Medni Chowki P. S. Case No. 19 of 2016 registered under Sections 341, 323, 354, 379, 504 and 307/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the specific allegation of causing injury is against one Ramdeo Mahato and the petitioner has been implicated in this case only because he happens to be the son-in-law of Ramdeo Mahato. He has further submitted that the two injuries found on the person of the informant are simple and superficial

Patna High Court Cr.Misc. No.29075 of 2016 (2) dt.26-07-2016 2/2 in nature and as such, the ingredients of the offence punishable under Section 307 of the Indian Penal Code would not be attracted in the present case.

Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioner. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in Medni Chowki P. S. Case No. 19 of 2016, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
