This is an application for bail in connection with Jankinagar P.S. Case No. 167 of 2016 registered for the offences punishable under Section 366A of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor girl of the informant.

Submission of learned counsel for the petitioner is that FIR itself shows that victim girl was talking term with the petitioner and the statement of victim girl recorded under Section 164 Cr.P.C. shows that petitioner has married with the victim girl and there is no allegation against him.

Heard learned APP also.

Having heard both sides and in view of allegation, I am

Patna High Court Cr.Misc. No.46716 of 2017 (2) dt.22-09-2017 2/2 not inclined to grant bail to the petitioner. However, petitioner may renew his prayer for bail after framing of charge in this case before the court below itself, which will be considered on the basis of materials available on record as well as the period of custody and the court below will pass an appropriate order.
