JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-08-2017 The petitioners seek regular bail in connection with Jhajha P.S. Case No. 132 of 2014, registered for offences punishable under Sections 379/511 of Indian Penal Code and Section 15(2) and 15(4) of the P.M.P. Amendment Act 2011 and Section 3/4 of the Prevention of Damage to Public Property Act, 1989.
Allegation against the petitioners is of stealing petrol from the pipe line of Petroleum Refinery.
It has been submitted on behalf of the petitioners that they have falsely been implicated in this case only on the basis of
suspicion and so far other criminal antecedents are concerned, they have been made accused in one case and, thereafter, remanded in all other cases and have been in judicial custody in this case since 11.05.2017.
Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Jamui, in connection with Jhajha P.S. Case No. 132 of 2014, with following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part two appear before the court below on two
consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail bonds.
