04-10-2017 Heard Sri Manoj Kumar Jha, learned counsel for the petitioner and learned Addl. Public Prosecutor. This is the second attempt for grant of bail on behalf of the petitioner. Earlier, by order dated 09-10-2015, the prayer for bail of petitioner, vide Cr. Misc. No. 22675 of 2015, alongwith co-accused Rani Devi, vide Cr. Misc. No. 22757 of 2015, was rejected. At the time of rejection of the bail petition, I had examined entire case diary and thereafter, the prayer for bail was rejected.
Learned counsel for the petitioner, at the moment, is not pressing bail petition on merit, rather he submits that in this case, prosecution has examined altogether 17 witnesses and out of 17 witnesses, 10 have been examined and most of the witnesses have turned hostile and in this case, this is the
Patna High Court Cr.Misc. No.45343 of 2017(2) dt.04-10-2017 2/2 changed circumstances for pressing the bail petition. However, I am of the opinion that since trial is going on and out of 17 witnesses, 10 have already been examined, there is no need to review my earlier order.
The prayer for bail again stands rejected.
However, while dismissing, it is desirable to observe that learned Trial Court may take appropriate step so that the case may come to its logical end without any further delay. (Rakesh Kumar, J.) anay U T
