====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-08-2021 Heard Mr. Krishna Kumar Singh, the learned Advocate for the petitioner, Mr. Anant Kumar Mishra, the learned Advocate for the informant and the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Bettiah Mufassil P. S. Case No.271 of 2019, instituted for the offences under Sections 341, 323, 376, 504, 420, 506/ 34 of the Indian Penal Code and Sections 4 and 12 of the POCSO Act.

After some arguments, the learned Advocate for the petitioner seeks permission to withdraw this application in order to enable the petitioner to surrender before the Court below and seek bail.

No.3910 of 2021(2) dt.04-08-2021 2/2 As and when such an application shall be filed, the Court below shall take into account the grounds urged namely that the petitioner has married the victim and now the victim has decided not to prosecute the petitioner any further, and shall pass orders in accordance with law without being prejudiced by the fact that the present petition on his behalf has not been entertained.

The petition is dismissed as withdrawn with the liberty aforesaid.
