ANJANA MISHRA ORAL ORDER 20-08-2016 As prayed for, learned counsel for the petitioner is permitted to make necessary correction in the first paragraph and the prayer portion of the application.

Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. Learned counsel for the informant is also present.

The petitioner is apprehending his arrest in connection with Mahila (Jehanabad) P.S. Case No.17 of 2016 for allegedly having committed the offence under Sections 341, 242, 354, 323, 504 and 506/34 of the Indian Penal Code and Section 8 of the POCSO Act.

Learned counsel for the petitioner submits that there is a case and counter case between the parties and Annexure 2 clearly reveals that it was the informant side, who had attacked this petitioner on 7.4.2016 at around 9.30 in the morning and

Patna High Court Cr.Misc. No.27634 of 2016 (2) dt.20-08-2016 2/2 thereafter, only to escape the allegation made by the present petitioner, the instant case has been lodged to cover up their own act of aggression.

Learned counsel for the informant, however, seriously contested the matter and submits that the girl has been saved by her grandfather.

However, taking into consideration all facts and circumstances and also the injury report from the P.M.C.H., which is dated 7.4.2016 itself, and which indicates sufficient injury on the person of the present petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction learned A.D.J.-I-cum-Special Judge, POCSO, Jehanabad, in connection with Mahila (Jehanabad) P.S. Case No.17 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
