The petitioner is apprehending her arrest in connection with Jale P.S. Case No. 36 of 2012 instituted for the offences punishable under Sections 406, 467, 468, 471 and 120(B) of the Indian Penal Code.
The prosecution case, in brief, is that the certificate of four A.N.M. were found forged on the basis of a letter of Civil Surgeon-cum-Chief Medical Officer Darbhanga. After inquiry, the FIR has been instituted against them. It is alleged that they also withdrawn some amounts respecting to scheme of N.H.S.C. and united fund, but they did not deposit voucher in the office concerned.
Patna High Court Cr.Misc. No.33507 of 2016 (3) dt.09-12-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Voucher in respect of Rs. 20,000/- has already been submitted vide Annexure-3 to the present application. The petitioner is a lady. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Jale P.S. Case No. 36 of 2012 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
