Petitioner apprehends arrest in connection with Goraul P.S. Case No. 160 of 2021 registered for the offence punishable under section 414 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case on basis of confessional statement of the co-accused. Nothing has been recovered from the conscious possession of this petitioner. Except the confessional statement, there is no material against the petitioner. Petitioner has no criminal

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing of his personal bond to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge, Excise, Vaishali at Hajipur in connection with Goraul P.S. Case 160 of 2021 subject to the conditions laid down under section 438(2) Cr.P.C.
