This is a case registered under Sections 25(1-b) a, 26 and 35 of the Arms Act.

On the statement made by one Keshav Singh and Mukesh Singh, the police raided the house of one Sanjay Singh and the said Sanjay Singh disclosed that he has kept the carbine in the house of the instant petitioner Sanjay Sah. Upon such disclosure the said carbine was recovered from the house of the petitioner and then he was arrested.

Counsel for the petitioner submits that the petitioner is a labourer working in the field of said Sanjay Singh and that the said Sanjay Singh himself stated that he concealed the alleged

He further submits that the petitioner has falsely been implicated in the instant case and on such false case he is in custody since 06.03.2017. Prior to the instant case, there is no criminal history of the petitioner. He also submits that the said Sanjay Singh, on whose statement the police has raided the house of the petitioner, has already been granted bail vide order dated 01.07.2017 passed in Cr. Misc. No. 29910 of 2017.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of District and Sessions Judge, Sheohar in Tariyani P.S. Case No. 29 of 2017.
