The petitioner, in the present case, is seeking regular bail in connection with Darbhanga Sadar P.S. Case No. 203 of 1998, registered for offences alleged under Sections 366 and 366A of the Indian Penal Code.
In this case, it appears that the petitioner had been granted bail on 10.02.1999, but thereafter when the records were committed to the court of Session on 19.02.1999, the petitioner did not appear before the trial court. The permanent warrant of arrest was issued against the petitioner. He has been arrested on 10.07.2018.
Patna High Court Cr.Misc. No.52503 of 2018 (3) dt.28-09-2018 2/2 Since, the petitioner has misused the privilege of bail and has absconded for about 19 years after getting the bail, this Court is not inclined to grant regular bail to the petitioner at this stage. This application is dismissed.
Let the trial be expedited and be concluded within a period of six months from the date of receipt/production of a copy of this order, failing which the petitioner may renew his prayer for bail.
