The petitioner seeks bail in connection with Bajpatti P.S. Case No. 270 of 2020 instituted for the offence under Section 30(a) of he Bihar Prohibition and Excise Act, 2016.
It appears from the prosecution report that the vehicles were found parked in the field of one Vijay Singh, from where, huge quantity of liquor was recovered. Learned counsel for the petitioner has submitted that his implication in the present case is only on the basis of statement by an arrested accused person.
The petitioner is in custody since 10.01.2021. The petitioner has been made accused in another case of the same nature but only after the lodging of the present case.
Considering the afore-stated facts and taking into account the period of custody of the petitoner, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Additional District & Sessions Judge-II-cum-Special Judge (Excise), Sitamarhi, in connection with Bajpatti P.S. Case No. 270 of 2020.
