The petitioners seek bail in anticipation of their arrest in connection with Govindganj (Malahi) P.S. Case No.192 of 2021 instituted for the offences under Sections 272, 273 of the Indian Penal Code & Section 30(a) of Bihar Prohibition and Excise Act.
Learned counsel for the petitioners submits that the petitioner was neither present at the sight nor recovery has been made from him and his name has been mentioned by other persons from which recovery has been made.
Taking into consideration the aforesaid aspect, I am satisfied that prima facie case under section 30(a) of the Bihar
Patna High Court CR. MISC. No.52646 of 2021(2) dt.17-02-2022 2/2 Prohibition and Excise Act is not made out against the petitioners, I am inclined to grant benefit of anticipatory bail to the petitioners and in the event of arrest, they shall be released on bail subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
