JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-02-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Khudawan P.S. Case No. 14 of 2020 registered for the offences under Sections 427, 307, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case in brief is that when the informant came out from his vehicle, two accused persons came and fired at the informant who received gunshot injury and fell down. The informant identified

The informant alleged that at some point of time, they were the drivers of the informant and earlier also they fired at him for which Pauthu P.S. Case No. 20 of 2012 was registered against them.
Learned counsel appearing on behalf of the petitioner would submits that although the petitioner was known to the informant, yet in the first part of the F.I.R, the informant alleged that two unknown persons came and fired at him but in the second part of the F.I.R, the name of the petitioner was disclosed by the informant.
The petitioner is in custody since 26.06.2020. Considering the totality of the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 50,000/- (Rupees fifty thousands) with two sureties of the like amount each to the satisfaction of learned
