1. Heard learned counsel for the petitioner and learned APP for the State.
2. Petitioner seeks regular bail in connection with Awatar Nagar P.S. Case No. 291 of 2022 dated 06.12.2022 registered for the offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code.
3. The main submissions advanced by learned counsel Mr. Ajit Kumar Singh appearing for the petitioner are that the petitioner has been languishing in jail since 12.02.2023 having fair and clean antecedent and against him the investigation has been completed, though he is named in the FIR but his specific role in causing injury to the victim has not been revealed and altogether nine accused persons including the petitioner have been named in the FIR and the main and serious
Patna High Court CR. MISC. No.45178 of 2023(2) dt.27-07-2023 2/2 allegation is against co-accused Guddu Nut and admittedly in between both the parties a land dispute is running.
4. Learned APP Mr. Rajiv Nayan appearing for the State has opposed the prayer for bail.
5. Having regard to the facts and circumstances of this case, considering the above submissions and mainly the facts that there is no specific allegation against this petitioner and the main allegation of causing injury to the deceased is against coaccused Guddu Nut and several persons have been named in the FIR and the petitioner has fair and clean antecedent, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Awatar Nagar P.S.
