The petitioner seeks bail in Patori P.S. Case No. 253/2017, instituted for the offences under Sections 302, 201 and 120(B)/34 of the Indian Penal Code.
It is alleged in the written report that son of informant, aged about 12 years, had left his house but did not return till evening. The informant made search, but his son could not be traced out. On the next morning, dead body of son of informant was recovered from a ditch. During investigation, it has come that there was some altercation between the son of informant and son of petitioner and threat was given to the son of informant. Learned counsel for the petitioner has submitted that the
Patna High Court Cr.Misc. No.51327 of 2018 (3) dt.25-09-2018 2/2 F.I.R. is against unknown. Besides suspicion, there is no any direct material against this petitioner in the entire case diary. The petitioner is in custody since 04.06.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Patori P.S. Case No. 253/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
