The petitioner apprehend his arrest in a case filed under Sections 376/ 384/ 385/ 420 / 120(B) of the Indian Penal Code and Section 3⁄4 of the Protection of Child from Sexual Offence Act.

It is contended on behalf of the petitioner that it is apparent from the first information report that Md. Firoz has committed rape upon the daughter of the informant. So far as petitioner is concerned, only allegation against him that he was one of the Punch when the panchayti was held in the village and a decision was taken that both the boy and the girl would be married, however, the said marriage could not take place.

Case No.31/16, Spl. Case No.8/16, the above named petitioner, Md. Asfaque shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the 1st Addl. Sessions Judge, Araria subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
