JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-10-2017 The petitioner seeks regular bail in connection with Pipra P.S. Case No. 40 of 2017, registered for offences punishable under Sections 304B/34 of Indian Penal Code.
Petitioner is husband of the deceased and allegation against the petitioner is causing dowry death of the deceased. It has been submitted on behalf of the petitioner that the death of the deceased is not within the seven years of her marriage, therefore, there is no application of Section 304B Indian Penal Code in this case and he has falsely been implicated in this case. Further petitioner has been in judicial custody since 21.06.2017.
Learned counsel for the State opposed the prayer for bail
Patna High Court Cr.Misc. No.46778 of 2017 (3) dt.11-10-2017 and submitted that daughters of the petitioners have stated about the involvement of petitioner in the death of the deceased. Having heard both sides, considering the fact and circumstances of the case and serious nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it within a period of one year. (Vinod Kumar Sinha, J) sunil/- U T
