Patna High Court MJC No.4770 of 2010(27) dt.01-11-2017 2/2 Umadevi (3) and others-(2006) 4 SCC 1 and the fact that there is no material available on record to show that appointment of the petitioners falls in the category of illegal appointment which could be regularized, in this contempt proceedings now in the light of the Constitution Bench judgment of the Supreme Court in the case of Umadevi (3) (supra) I am not inclined to initiate any action for contempt. In case the petitioners feel that the petitioners have been discriminated and persons similarly situated have been regularized and same benefit has not been granted to the petitioners, petitioners may take recourse to such remedy as may be available under law for enforcing their right based on the discrimination but in the light of the law laid down by the Constitution Bench in the case of Umadevi (3) supra, I am not inclined to proceed with the contempt application. The application stands disposed of.
