The petitioner apprehends his arrest in Begusarai Town P.S. Case No. 354/2015, registered for the offences punishable under Sections 273, 120, 34 of the Indian Penal Code and 47(A) of the Excise Act.
The police raided Shivam Dhaba and recovered 55 bottles of different brands of beer. The apprehended accused disclosed that the petitioner is the owner of Shivam Dhaba. It is submitted that the petitioner is not the owner of Shivam Dhaba. He has no manner of concern with the aforesaid Dhaba. The police did not collect any further evidence to show that the petitioner was running the aforesaid Dhaba. The petitioner has got no criminal antecedent.
Considering the facts aforesaid, the petitioner above
Patna High Court Cr.Misc. No.44072 of 2015 (3) dt.18-12-2015 named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 354/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
