The petitioners apprehend their arrest in connection with Nabinagar P.S. Case no. 25 of 2016, registered under Sections 420, 406 & 409/34 of the Indian Penal Code.
The accusation is that money was distributed to the petitioners to construct the house in Nagar Panchyat Navinagar, but the same was constructed by the petitioners in Sinduriya village under Rampur Panchyat.
Learned counsel for the petitioners submits that Nabi Nagar Panchyat and Rampur Panchyat are adjacent to each other and there is no allegation against the petitioners that they have misappropriated the money. Further submission is that petitioners

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Aurangabad in connection with Nabinagar P.S. Case No. 25 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
