This application is for grant of regular bail in connection with Patahi P.S.Case No.175 of 2016, registered for the offences punishable under Sections 387 of the Indian Penal Code.

Allegation against the petitioner is of extortion. Submission of the learned counsel for the petitioner is that there is delay in lodign of FIR of 37 days and further the petitioner has remained in custody for about eight months. The mobile does nto belong to the petitioner and he has no criminal antecedent.

Heard learned A.P.P. also, who has opposed the

Patna High Court Cr.Misc. No.39167 of 2017 (3) dt.07-09-2017 2/2 prayer for bail.

Having heard both sides and in view of the facts and circumstances and also the fact that the mobile has been recovered from the possession of the petitioner, as such, at this stage, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer for bail before the court concerned. With the aforesaid observation, this application is dismissed.
