====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER --------------- 27-01-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Chousa P.S. Case No.144 of 2014 registered under Sections 302/34 of the Indian Penal Code besides Section 27 of the Arms Act pending in the court of the Judicial Magistrate, First Class, Uda-Kishunganj ( Madhepura).

The accusation is that the petitioners alongwith eight others, named in the F.I.R., surrounded Vikash Singh, the brother of the informant Pappu Kumar, in course of returning to his house and opened fire upon him due to which he sustained injuries and

Patna High Court Cr.Misc. No.46853 of 2015 (3) dt.27-01-2016 2/2 died. In that course, the co-accused, Anavesh Singh and Viran Singh were apprehended by the villagers and were assaulted. Learned counsel appearing on behalf of the petitioners submits that no specific overt act is attributed to the petitioners and the informant is not an eye witness to the occurrence. Having considered the facts and the circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, the prayer of the petitioners for grant of anticipatory bail stands rejected.
