This application, for grant of anticipatory bail, arises out of Amarpur P.S. Case No. 21/2017, disclosing offences under Sections 341, 323, 337, 308, 379, 504 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that in course of investigation he was given the benefit of Section 41-A of the Code of Criminal Procedure and he always participated in course of investigation in terms of notice and never misused the said privilege, as has been stated in paragraph 10 of the petition. He submits that now since the charge sheet has been submitted, no purpose will be served by taking the petitioner into custody, since he is ready to appear before the court below as and when required.

Let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 21/2017, subject to the condition laid down under Section 438(2) of the Cr.P.C. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
