Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Dumraon P.S. Case No. 149 of 2022 registered for offence punishable under section 412 of the Indian Penal Code and sections 25 (1-b)a/26/35 of the Arms Act.

Patna High Court CR. MISC. No.42412 of 2022(2) dt.16-11-2022 2/3 motor cycle. That motor cycle was intercepted by the police and two persons were arrested. They disclosed their names as Golu Singh @ Raja Singh @ Raja Kumar Singh and Bablu Yadav. Rs. 50,000/- cash and one mobile were recovered from the possession of the petitioner and from the possession of co-accused, Babloo Kumar, a country-made pistol and live cartridges were recovered.

The learned counsel for the petitioner has submitted that on intensive interrogation by the police, the petitioner disclosed that they have committed dacoity in Mitali Petrol Pump with the accused persons, whose names he disclosed and the pistol and the money, which was recovered by the police, was the looted property of that crime. The petitioner has also disclosed that at the occasion of committing loot in that petrol pump, the same pistol was used.

The learned counsel for the petitioner has submitted that no arms and ammunition has been recovered from the possession of the petitioner, rather it was recovered from the co-accused, Babloo Kumar. He has submitted further that the petitioner is under custody since 24.03.2022. He has also submitted that there is no charge sheet under section 412 of the Indian Penal Code.

Patna High Court CR. MISC. No.42412 of 2022(2) dt.16-11-2022 3/3 The petitioner disclosed his complicity in dacoity as mentioned in the FIR. He is a person of strong criminal antecedents. There are two cases under sections 302 and other allied section, pending against him.

In my view, the petitioner does not deserve the privileges for bail. Accordingly, the prayer for bail is rejected. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
