2. The petitioner apprehends arrest in connection with Daudnagar P.S. Case No. 207 of 2024 dated 05-05-2024, instituted for the offence punishable under Section 21 of the N.D.P.S. Act.

3. The allegation is of recovery of 790 milligram of brown sugar from the apprehended co-accused persons, namely, Amit Kumar and Ravi Kumar who disclosed the name of two persons who succeeded in fleeing away from the spot as Sanjeet Kumar @ Laffu ( petitioner) as well as Pramod Kumar.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that the petitioner has been made accused

Patna High Court CR. MISC. No.44946 of 2024(2) dt.24-07-2024 2/2 only on the basis of the confessional statement of apprehended persons, which has no evidentiary value. It is submitted that there is no recovery either from the conscious possession of the petitioner or from his house. Lastly, it has been submitted that petitioner has no criminal antecedents.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest/surrender before the learned Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, (N.D.P.S.) -cum-1st Additional District and Sessions Jude Aurangabad, Bihar, in connection with Daudnagar P.S. Case No. 207 of 2024, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Khatim Reza, J) shyambihari/- U T
