The petitioner seeks bail in Sarmera P.S. Case No. 7 of 2020, registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

As per the prosecution case, co-accused Mauli Kewat took the youngest brother Guddu Kewat to drink liquor with him, but he did not return. On the next morning, dead-body of his brother was found in a field of Narayan Yadav. Informant suspected that Karu Yadav, Mauli Kewat and 3-4 unknown persons called his brother and killed him by sharp cutting weapon, as earlier there was altercation between his brother and Karu Yadav on the issue of plucking Khesari sag. It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of

Patna High Court CR. MISC. No.52522 of 2021(2) dt.30-11-2021 2/2 investigation, name of this petitioner has come in this case on the basis of confessional statement of co-accused Mauli Kewat who has been granted bail by this Court 23.11.2020 passed in Cr. Misc. No. 22911 of 2020. Petitioner is in custody since 15.10.2020 having clean antecedent.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Fast Track Court No. II, Nalanda at Biharsharif in connection with Sarmera P.S. Case No. 7 of 2020.
