====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 27-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Katihar Town P.S. Case No. 293 of 2018 instituted for the offence under Sections 376, 497, 498 and 153A of the Indian Penal Code.
Counsel for the petitioner submits that from the written report and the statement of victim girl (informant) recorded under Section 164 Cr. P.C. it would be apparent that everything was done with consent of the informant. The informant is widow.
Case diary along with statement of the informant under Section 164 Cr. P.C. has been received. From perusal of 164 statement it appears that all acts were done with consent of the informant. The dispute only arose when petitioner insisted the informant to change her religion.
Patna High Court Cr.Misc. No.51169 of 2018(3) dt.27-11-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Katihar Town P.S.
