JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-07-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 21.12.2020, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Minapur P.S. Case no. 31 of 2020, registered under Section 272 and 273 of the Indian Penal Code and Section 30(a) & 41(i) of the Bihar Excise and Prohibition (Amendment) Act, 2018.
The accusation is that in course of patrolling duty
Patna High Court CR. MISC. No.37836 of 2020(2) dt.06-07-2021 2/3 one Maruti Suzuki car bearing its registration No. BR06BR7703 was seen. On seeing the Police personnel, three persons boarded on the alleged vehicle started fleeing, while they were chased, but, they managed to escaped from there leaving the said Maruti Suzuki car. At that time, local Chowkidar identified them as Md. Alam, Bittu Kumar (Petitioner) and Ramesh Kumar. On search of the aforesaid Maruti Suzuki car, 18 bottles, each containing 375 ML Indian Made Foreign Liquor recovered.
Learned counsel for the petitioner submits that petitioner was not apprehended on the spot nor the petitioner has any concern with the seized vehicle from which 18 bottles of Indian Made Foreign Liquor is said to be recovered. Further submission is that due to dirty village politics, the local Chowkidar disclosed the name of petitioner. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge
