JUSTICE SANDEEP KUMAR ORAL ORDER 30-01-2023 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Piro Police Station Case No. 267 of 2012 registered for the offence under Sections 395, 397 and 120(B) of the Indian Penal Code. As per prosecution case, two persons holding Pistol and Katta in their hands entered into the house of the informant and snatched Rs. 16,000/-, two golden chains and two golden rings on the point of Pistol.

Patna High Court CR. MISC. No.42355 of 2022(4) dt.30-01-2023 2/3 The petitioner is not named in the F.I.R. His name has come on the basis of confessional statement of co-accused. Further, the petitioner has three criminal antecedents of similar nature.

It has been contented by the learned counsel for the petitioner that no T.I. Parade has been conducted. In view of the facts and circumstances, as mentioned above, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer of bail of the petitioner is rejected.

The District Judge, Buxar is directed to transfer the following cases in one Court and get the trial of the following cases expedited.

(I). Piro (Hasan Bajar) P.S. Case No. 101 of 2012. (II). Piro P.S. Case No. 112 of 2012.

(III). Nava Nagar P.S. Case No. 165 of 2016.

The Superintendent of Police, Buxar is directed to explain as to why T.I. Parade was not held and what action is proposed to be taken against such erring officials. The report must be filed through personal affidavit of the Superintendent of Police, Buxar.
