The petitioner apprehends his arrest in connection with Digha P.S. Case No. 55 of 2016 for the offences registered under Sections 182, 211, 201, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the entire allegation as made out against the petitioner is motivated and misconceived and none of the offences as alleged are made against the petitioner. It is further submitted that whatever be the allegation, all the sections are bailable in nature and the offence under Section 201 of the Indian Penal Code is not made out against the petitioner.

Patna High Court Cr.Misc. No.33595 of 2016 (3) dt.05-10-2016 Considering the nature of allegation made against the petitioner and that the petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Digha P.S. Case No. 55 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
