JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,376 and 511/34 of the Indian Penal Code.

The prosecution case is that when the informant's niece went to ease out then the petitioner along with co accused Girish Mahaton, Nanak Mahaton, Baleshwar Mahaton and Chhotu Kumar assaulted and made attempt to ravish her. It is submitted by the learned counsel for the petitioner that on conclusion of investigation the final form (chargesheet) was submitted only under sections 341,323,354 and 504/34 IPC. Patna High Court Cr.Misc. No.45153 of 2015 (2) dt.03-11-2015 2/2 petitioner have been granted anticipatory bail vide Cr. Misc. No. 45652 of 2015. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Munger in connection with Kasim Bazar P.S. Case No.108 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
