====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 30-01-2019 Heard Sri Bikramdeo Singh, learned counsel, assisted by Shree Niwas Singh, learned counsel for the petitioner and learned Additional Public Prosecutor.
The petitioner, who is in custody in connection with Garhpura P.S. Case No. 5 of 2018 registered for the offence under Section 385 / 392 of the Indian Penal Code, 1860, has prayed for grant of bail.
Sri Bikramdeo Singh, learned counsel for the petitioner submits that only on suspicion petitioner has been made accused. He submits that it appears that petitioner has been made accused due to the reason that petitioner was having relation with one of the main accused who was inside jail otherwise there is no other material.
Patna High Court Cr.Misc. No.49192 of 2018(5) dt.30-01-2019 2/2 Learned Additional Public Prosecutor opposing the prayer for bail submits that in the case diary, which was earlier summoned and has been received there is some material showing involvement of petitioner. He further submits that prayer for bail of some of the co-accused has already been rejected by this court after perusal of case diary. Besides hearing, I have also examined material available on record and after going through the same, I do not find any ground to pass favourable order.
The prayer for bail stands dismissed.
