The petitioner, who is in custody, seeks bail in connection with Sultanganj P.S. Case No. 87 of 2018 registered for the offence punishable under Section 364 of the Indian Penal Code and later on added under Sections 302, 201, 120B/34 of the Indian Penal Code.

Informant has alleged in the FIR that on 17.04.2018 at about 10.30 PM his elder brother Babloo Ram had gone to Maheshwari Plaza, Rampur but he did not return till 12.00 noon. On confession made by co-accused Munna Ram dead body was recovered but in said confession and confession made by other accused also no overt act has been attributed

Patna High Court Cr.Misc. No.51040 of 2018(2) dt.04-10-2018 2/2 against petitioner.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case on suspicion only. He has been roped in this case only because he is relative of other co-accused. Petitioner has no criminal antecedent and he surrendered on 01.05.2018 and since then he is in custody.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Patna City, Patna, in connection with Sultanganj P.S. Case No. 87 of 2018.
