JUSTICE SANJAY PRIYA ORAL ORDER 08-08-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in Baheri P.S. Case No. 242 of 2015 instituted for the offence under Sections-363, 366/34 of the Indian Penal Code.

It has been submitted that the police after investigation, submitted final form against these petitioners but the court below differing with the final form, has taken cognizance against these petitioners also along with other accused. It has been submitted that the victim girl in her statement recorded u/S 164 of the Cr.P.C., has levelled specific allegation against co-accused Ramesh Mukhiya. It has further been submitted that co-accused Ramesh Mukhiya has already been granted bail by coordinate bench of this court vide order dated 2507-2017 passed in Cr. Misc. No. 27013 of 2017. In such circumstances, prayer for bail is allowed. The

Patna High Court Cr.Misc. No.37407 of 2017 (2) dt.08-08-2017 petitioners named above are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Baheri P.S. Case No. 242 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Darbhanga subject to condition that both the bailors should be close relative of the petitioners.
