The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and (c) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 20 litres of liquor was recovered from the house of the petitioner.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or his house. He has been falsely implicated in the case because of his antecedent. He is in custody since 4.2.2021 and investigation in the case has been completed. It is further submitted that a supplementary affidavit has been filed on behalf of the petitioner stating therein about the antecedent of the petitioner.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Buniyadganj P.S. Case no.22 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd -cum-Special Judge, Excise Act, Gaya.
