The petitioner apprehend his arrest in connection with Lakhisarai P.S. Case No. 102 of 2016, registered under Sections 419, 420, 467, 468 and 120(B) of the Indian Penal Code and Section 10 of Bihar Conduct of Examination, Act 1981, pending in the court of the Chief Judicial Magistrate, Lakhisarai. The accusation is that on 26.02.2016, in course of examination of Physic (first sitting) of Intermediate at Balika Bidhyapith, Lakhisarai, one Arun Kumar was found sitting at the place of the petitioner.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly,

Patna High Court Cr.Misc. No.33289 of 2016 (2) dt.26-08-2016 2/2 his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trail Court within six weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
