JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2017 Earlier prayer for bail of the petitioner was rejected by this Court in Cr.Misc.No.55026 of 2016, vide order dated 22.12.2016 with a direction to the trial court to conclude the trial within a period of six months.

It has been submitted by learned counsel for the petitioner that trial has not been concluded within the specified period, as such, this application has been filed for grant of bail on the ground that other co-accused having similar allegation have been granted bail and in spite of direction though charge has been framed but not a single witness has been examined in this case. Heard learned counsel for the petitioner and learned APP for the State.

Having heard both sides and considering the aforesaid

Patna High Court Cr.Misc. No.38667 of 2017 (2) dt.23-08-2017 2/2 facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge-VII, Aurangabad, in connection with Sessions Trial No. 305/2016/125 of 2016, arising out of Rafiganj P.S.Case No. 125 of 2013, subject to the condition that one of the bailors shall be a responsible person either Public Representative or Government Servant having sufficient properties within the jurisdiction of court concerned and he will co-operate in trial and appear on each and every date fixed in the case and further condition that petitioner shall report to the concerned police station in first week of every month till conclusion of trial, failing which his bail bond shall be cancelled.
