JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-02-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Raghopur P.S. Case No.260 of 2019 for the offence under Sections 407, 409 and 420/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner would submit that in the instant case, there is allegation that in connivance with the petitioner, there is embezzlement of Rs. 9,58,613.24/- as the petitioner and others have not properly accounted for fertilizer which was sent from BISCOMAUN to Kisan Seva Kendra set up at different places in the district. Mr. Ajay Kumar Thakur, learned counsel for the petitioner, submits that as per the audit report, an amount of

Patna High Court CR. MISC. No.38678 of 2020(2) dt.08-02-2021 2/2 Rs. 2,06,471/- was recoverable from Baldev Ram and an amount of Rs.7,52,142.24/- was recoverable from Ganesh Kumar and nothing was found recoverable from the petitioner. Petitioner is in custody since 02.06.2020.

Considering the aforesaid, the Court is inclined to grant bail to the petitioner. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees one lakh) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Birpur in connection with Raghopur P.S. Case No. 260 of 2019.
